Terms and conditions

These terms and conditions govern purchases from the Moja Luč online shop at mojaluc.si. They apply to every order placed through this site and form part of the contract between you and the seller. By placing an order you confirm that you know and accept them.
How we handle personal data is described in a separate privacy policy. These terms do not limit your statutory rights as a consumer — where any provision conflicts with the law, the law prevails.

1. Scope
These terms apply to all purchases from the Moja Luč online shop at mojaluc.si. Each order is governed by the version published when it was placed.
The shop is intended mainly for consumers — individuals buying for themselves or as a gift, not in the course of their profession. Provisions on consumer rights apply to consumers only. Orders may be placed by adults.
2. Language and record of the contract
The contract is concluded in Slovenian; the English version of these terms is for information, and the Slovenian version prevails if they differ. We keep the order with all its details in our database and email you a summary with a “Purchase receipt” attached. You can print or save these terms from this page at any time.
3. Products and personalisation
We describe products as accurately as we can. Photographs and the 3D preview show the product as it will be made, but colours on screen may differ slightly from the real ones.
A gift with a name is made exactly with the text you enter — the same letters, spaces and punctuation. Please check the text and the preview carefully before paying; we do not correct spelling or other mistakes in the text you enter.
We do not make orders whose text is offensive, unlawful or infringes the rights of others; in that case we cancel the order and refund the full amount.
4. Prices
Prices are in euros and include VAT. Delivery is not included in the product price; it is shown in the basket and at checkout before you pay. The price shown when you place the order applies.
A struck-through price is the lowest price at which we sold the product in the 30 days before the reduction.
If a price is significantly wrong because of an obvious error, such as a typo, we will tell you and offer you the purchase at the correct price or cancellation with a full refund.
5. Discounts and free gifts
You enter a discount code in the basket. A code is valid for one order unless explicitly stated otherwise. Codes you receive when signing up for the newsletter, in the Birthday Club or in another personal message are tied to your email address and valid only for it. Discounts cannot be exchanged for cash.
When the shop offers a free gift above a certain amount, the gift is added to the basket automatically once the value of the goods after discounts reaches the threshold. If a discount code brings the value below the threshold, the gift is removed. One gift can be received per order.
6. Placing an order and conclusion of the contract
You place an order as follows:
- add a product to the basket — for a gift with a name, first enter the text and check the preview;
- in the basket, check the products, quantities and text, and add a discount code or “Skip the queue” if you wish;
- at checkout, enter your email and delivery address and check the summary with all costs;
- pay on Stripe’s payment page;
- after a successful payment you receive an order confirmation by email.
Until you pay you can correct anything: change quantities or remove items in the basket, correct your details at checkout, and go back from the payment page.
The contract is concluded when the payment is confirmed and we send you the order confirmation. If the payment fails or is not completed within one hour, the order expires and no contract is concluded.
7. Payment
Payment is carried out by Stripe on its secure payment page. The available payment methods — payment cards and other methods Stripe offers for your device — are shown on the payment page. The amount is charged when you pay for the order.
We neither receive nor store your card details. After payment we email you a “Purchase receipt” as a PDF.
8. “Skip the queue”
“Skip the queue” is an optional paid upgrade: we start making your order before orders that do not have it. The price is shown in the basket and is charged once per order, however many items it contains.
It is not a promise of a dispatch or delivery date — that also depends on the courier. It does not count towards free delivery and discounts do not apply to it. If the order contains an item for which the upgrade is not available, we do not charge for it.
9. Production and delivery
Gifts with a name are made to your order once payment is confirmed, so dispatch takes a few days longer than for items in stock. We do not promise a delivery date until we can guarantee one based on real orders.
We currently deliver only to addresses in Slovenia. The delivery price and the amount above which delivery is free are published on the “Delivery and payment” page and shown in the basket. We email you when the parcel is dispatched.
If we cannot fulfil an order — for example because an item sold out while you were paying — we cancel it, refund the full amount to the same payment method and let you know. The risk of loss or damage passes to you when you, or a person you designate, receive the parcel.
10. Receiving the parcel
When you receive the parcel, check that it is undamaged. If the packaging is visibly damaged, note it with the courier if you can, photograph the gift and write to us at info@mojaluc.si as soon as possible. We replace a damaged gift or refund it, at our cost.
11. Right of withdrawal
As a consumer you may withdraw from the contract within 14 days of the day you, or a person you designate, receive the product, without giving a reason. For an order of several items delivered separately, the period runs from receipt of the last one.
The right of withdrawal does not apply to gifts with a name or other text you enter, because they are made to your specifications and personalised for you (Article 16(c) of Directive 2011/83/EU, transposed into the Slovenian Consumer Protection Act, ZVPot-1). It does apply to products without personalisation.
Tell us you are withdrawing with an unambiguous statement to info@mojaluc.si — you may use the form in the next section, but you do not have to. The deadline is met if you send the statement before it expires.
- Return the product within 14 days of telling us you are withdrawing; we send you the return address in our reply. You bear the direct cost of returning it.
- We refund the price, including the cost of standard delivery, within 14 days of receiving your withdrawal, to the payment method the purchase was paid with.
- We may withhold the refund until we have received the product or proof that it has been sent back.
- You are liable for any reduction in the product’s value only if it results from handling beyond what is necessary to establish its nature, characteristics and functioning.

13. Liability for conformity
We are liable for our products as the law provides: a product must match its description and the order — for a gift with a name, also the text you entered. We are liable under ZVPot-1 for any lack of conformity that exists at delivery and becomes apparent within two years of delivery.
Tell us about a lack of conformity as soon as you notice it, at info@mojaluc.si, with the order number and a photo. We first repair the product or make it again; if that is not possible or does not succeed within a reasonable time, you may ask for a price reduction or withdraw from the contract and receive a refund. We bear the costs of putting the lack of conformity right.
If a name is spelled wrongly through our fault, we make the gift again free of charge. Mistakes in the text you entered are not a lack of conformity.
14. Guarantee
We do not give a separate (commercial) guarantee for our products, so there is no guarantee certificate. This does not affect your statutory rights described in the previous section.
15. Complaints
Send complaints to info@mojaluc.si. We confirm receipt within eight working days, tell you how long handling will take, and keep you informed of progress. We usually answer email within two working days.
16. Out-of-court dispute resolution
We try to settle disputes by agreement. The shop does not currently recognise any out-of-court consumer dispute resolution provider as competent to resolve disputes brought by a consumer. The list of providers recognised by the Republic of Slovenia is published on the website of the ministry responsible for the economy (gov.si).
Your right to go to court is not limited by this.
17. Product reviews
A review can be submitted by a customer after their order is dispatched, through a personal link that works only for that order — so every such review comes from a real purchase. We check every review before publishing it; we publish positive and negative reviews, but not reviews that are offensive or unrelated to the product.
Some reviews are entered into the shop by us. These are not tied to an order placed in the online shop, so for them we do not verify the purchase against an order.
18. Intellectual property
The content of this site — texts, photographs, product models and design — is ours or used with permission, and may not be used for other purposes without our permission. By entering text for personalisation you confirm that you may use it and that it does not infringe the rights of others; we use it only to make your order.
19. Limitation of liability
We work to keep the site running without interruption and its information accurate, but we cannot guarantee it will always be available. We are liable for indirect loss only to the extent the law provides. This limitation does not apply to damage caused intentionally or through gross negligence, and does not affect your rights as a consumer.
20. Force majeure
We are not liable for delays or non-performance caused by circumstances beyond our control — such as natural disasters, power or network outages, courier strikes or measures by public authorities. We will tell you about such a circumstance; if it lasts a long time, you may cancel the order and receive a full refund.
21. Newsletter, Birthday Club and privacy
Signing up for the newsletter and the Birthday Club is voluntary and not a condition of purchase. How we handle personal data is described in detail in the privacy policy.
22. Changes to these terms
We may change these terms. Changes apply to orders placed after the new version is published; orders already placed remain governed by the version in force when they were placed. The date of the last change is shown at the top of the page.
23. Governing law and jurisdiction
The contract is governed by the law of the Republic of Slovenia, without depriving a consumer of the protection given by the mandatory rules of the country where they habitually reside. Disputes fall under the competent court in the Republic of Slovenia; a consumer may also bring proceedings before the court of their place of residence where the law provides for it.
